The agreement between you and Offli covering accounts, real-money skill challenges, prize pools, payments, and disputes.
These Terms of Service (the "Terms") are a binding agreement between you and Offli, Inc. ("Offli", "we", "us", or "our"), which operates the Offli mobile application and the offli.app website (together, the "Service"). By creating an account or using the Service, you accept these Terms, the End User License Agreement, and the Privacy Policy. If you do not agree, do not use the Service.
You must provide accurate information, keep it current, and keep your login credentials confidential. You are responsible for all activity under your account.
The Service is offered only to individuals physically located and residing in the United States. To create an account you must be at least 18 years old. To enter any challenge that has an entry fee or awards a prize, you must be at least 18 years old, or older where your state's age of majority is higher (currently 19 in Alabama and Nebraska).
Real-money (paid-entry, cash-prize) challenges are not available to residents of every state. We do not offer real-money challenges to residents of states whose gaming laws restrict paid-entry prize contests. The current list and the legal basis for it are set out in the Eligibility & State Availability disclosure, which is part of these Terms.
You may hold only one account. You agree that the residency, age, identity, and payment information you provide is true, and you authorize us to verify it, including through location and identity checks. Using the Service where it would be unlawful for you to do so is prohibited and is your responsibility.
Offli is a self-control competition. You choose one or more apps and a daily time limit, and you win a challenge by keeping your own usage of those app(s) at or under your limit for every day of the challenge. Compliance is verified on your device using Apple's Screen Time / Family Controls framework. Offli receives only the daily verification result for your selected apps — pass/fail and, at most, a coarse minutes reading — never your app list or what you do in any app (see the Privacy Policy for the exact data flows).
Because the outcome depends solely on your own conduct, Offli challenges are contests of skill and self-control, not games of chance (see Section 5).
Real-money challenges are contests denominated in US dollars. The following terms apply to them:
Under US law an activity is unlawful gambling only if it combines a prize, consideration (an entry fee), and chance. Offli challenges have a prize and an entry fee, but they contain no chance: the result is decided solely by whether you keep your own app usage under your own limit, verified by Apple Screen Time. There is no random draw, no dealt outcome, no head-to-head matchmaking, and no wager against the house. Your result does not depend on any other participant — every entrant who meets the skill requirement wins.
Offli is therefore structured and operated as a skill-based accomplishment contest: a payment contingent on your own performance of a task within your own control. We nonetheless do not offer real-money entry in a small number of states whose statutes restrict paid-entry play for money even where skill controls the outcome, as described in the Eligibility & State Availability disclosure.
Entry-fee charges and prize payouts are processed by a third-party payment processor, and your use of payments is subject to the processor's terms in addition to these Terms. You authorize us and our processor to charge your selected payment method for entry fees you commit to.
To comply with applicable law and to prevent fraud, we may require identity verification (including your legal name, date of birth, and address) and location verification before you deposit funds, enter a real-money challenge, or receive a payout, and we may withhold entry or payout until verification is complete.
You are solely responsible for any taxes owed on prizes you receive. Where required by law, we will collect a taxpayer identification number and issue tax forms (for example, IRS Form 1099) for net winnings at or above the reporting threshold. Chargebacks or payment reversals made in bad faith are a breach of these Terms.
Offli is intended to help you reduce screen time, not to encourage excessive spending. You can set the entry-fee amounts you are comfortable with, and you can request account limits or self-exclusion at any time by contacting support@offli.app. If we reasonably believe continued play is harmful, we may limit or close your account.
You agree not to tamper with or falsify Screen Time data, use jailbroken or modified devices to defeat verification, use multiple or shared accounts, use bots or automation, misrepresent your residency, age, or identity, or otherwise manipulate a challenge or the Service. You also agree not to use the Service to break the law, infringe others' rights, or harass anyone.
Violations may result in disqualification, forfeiture of entry fees, withholding of payouts, and termination of your account.
Please contact support@offli.app first; most issues are resolved quickly and informally. If we cannot resolve a dispute within 30 days, you and Offli agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the Consumer Arbitration Rules of the American Arbitration Association (AAA), seated in Wilmington, Delaware.
You and Offli waive the right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. You may reject this arbitration agreement by emailing legal@offli.app within 30 days of first accepting these Terms; rejecting arbitration does not affect any other part of these Terms. Nothing here prevents either party from bringing an individual claim in small-claims court.
These Terms are governed by the Federal Arbitration Act and the laws of the State of Delaware, without regard to its conflict-of-laws rules, except to the extent the mandatory consumer-protection or gaming laws of your state of residence apply.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that verification will be uninterrupted or error-free; verification depends on Apple's Screen Time framework operating on your device.
To the fullest extent permitted by law, Offli will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to the Service is limited to the greater of the amounts you paid to Offli in entry fees in the 12 months before the claim or US $100.
You agree to indemnify and hold harmless Offli and its officers, employees, and agents from claims and expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may update these Terms; material changes will be posted here with a new version date and, where they affect real-money play, will require your renewed acceptance before you continue. You may stop using the Service and delete your account at any time from Settings; deleting your account during an active real-money challenge forfeits any committed entry fee as described in Section 4.
