Who can play for real money, where real-money challenges are available, and the state laws behind it.
Offli is available only to individuals located and residing in the United States. All Offli challenges are real-money challenges settled in US dollars (during the beta, balances may be simulated test credit with no cash value). Real-money challenges are available in most states, subject to the restrictions below.
US law treats an activity as unlawful gambling only when a prize, consideration (an entry fee), and chance are all present. Offli's real-money challenges have a prize and an entry fee, but no chance: you win by keeping your own app usage under your own limit, verified by Apple Screen Time. Most state gambling statutes define gambling as risking value on a contest of chance or on a future event "not under the person's control or influence" — and an Offli outcome is entirely under your control. Your result also does not depend on any other participant: every entrant who stays under their limit wins a share of the pool.
States evaluate the "chance" element under one of three standards — the predominant-factor test (most states), the material-element test (for example New York and New Jersey), and the strict "any chance" test (for example Iowa and Tennessee). Offli's design contains no chance, so it satisfies all three. This is the same accomplishment-contest model used for years by paid wellness challenges (weight-loss and step-count pools) available throughout the United States.
Residents of the following states cannot enter paid, real-money challenges: Arkansas (AR), Connecticut (CT), Delaware (DE), Louisiana (LA), South Dakota (SD). Because all Offli challenges are real-money, Offli challenges are not available to residents of these states.
These states have statutes that restrict paid-entry play for money even where skill fully controls the outcome — for example, by prohibiting wagers on games "of hazard or skill," by restricting for-profit contests in which entrants risk something of value, or by broadly criminalizing internet wagering. The list may change as laws evolve; the current list in the app and on this page controls.
You must be at least 18 to enter any challenge with an entry fee or a prize. Some states set a higher minimum because their age of majority is higher: AL (19+), NE (19+).
Some states require registration and a surety bond for prize promotions above a set amount — for example NY (over $5,000), FL (over $5,000). For residents of those states, Offli keeps prize pools below the applicable threshold unless the required registration and bond are in place.
